He or she has been ordered to report to a correctional centre (JVA) at a certain time or within a certain period - either because of a prison sentence or a substitute prison sentence. This is an extremely stressful situation: you are torn out of your normal life, family structures are jeopardised and your professional existence may be threatened.<\/p><p data-start=\"891\" data-end=\"1159\">But is there still a way to prevent or at least delay the start of a prison sentence in this situation? Yes - but only to a limited extent and often only in exceptional cases. Below is a structured overview of the most important options.<\/p><hr data-start=\"1161\" data-end=\"1164\" \/><h2 data-start=\"1166\" data-end=\"1218\">I. Legal force = hardly any possibilities for intervention<\/h2><p data-start=\"1220\" data-end=\"1828\">Before we come to the specific instruments: It is important to know that a summons to appear for sentencing is usually only issued once the underlying judgement or summary penalty order has been issued. <strong data-start=\"1404\" data-end=\"1421\">legally binding<\/strong> has expired. This means that the usual appeal period (e.g. appeal or revision) has expired or has been exhausted. In this situation, a classic <strong data-start=\"1579\" data-end=\"1602\">Appeal<\/strong> against the judgement is no longer possible. Of course, in exceptional cases there is still the possibility of a retrial or a constitutional complaint, but these procedures typically take effect too late to prevent a prison sentence being imposed.<\/p><p data-start=\"1830\" data-end=\"1963\">As soon as legally binding, there are usually onlygenerally only options in the <a href=\"https:\/\/so-anwaelte.de\/en\/criminal-law\/#vollzug\"><strong data-start=\"1898\" data-end=\"1930\">Enforcement proceedings<\/strong> <\/a>- and these are very limited.<\/p><hr data-start=\"1965\" data-end=\"1968\" \/><h2 data-start=\"1970\" data-end=\"2043\">II. Objections to enforcement and postponement of sentence, section 458 of the Code of Criminal Procedure<\/h2><p data-start=\"2045\" data-end=\"2183\">Even if the judgement is legally binding, under certain conditions <strong data-start=\"2127\" data-end=\"2143\">Objections<\/strong> be raised against the enforcement:<\/p><ul data-start=\"2185\" data-end=\"2498\"><li data-start=\"2185\" data-end=\"2271\"><p data-start=\"2187\" data-end=\"2271\">Doubts in the interpretation of the judgement (e.g. conflicts between the operative part and the reasons)<\/p><\/li><li data-start=\"2272\" data-end=\"2377\"><p data-start=\"2274\" data-end=\"2377\">Doubts in the calculation of the sentence (e.g. unclear regulations on the crediting of pre-trial detention)<\/p><\/li><li data-start=\"2378\" data-end=\"2498\"><p data-start=\"2380\" data-end=\"2498\">Obstacles to enforcement such as statute of limitations, doubts about identity, amnesty or procedural delays contrary to the rule of law<\/p><\/li><\/ul><p data-start=\"2500\" data-end=\"2887\">According to<a href=\"https:\/\/dejure.org\/gesetze\/StPO\/458.html\"> <strong data-start=\"2506\" data-end=\"2527\">\u00a7 Section 458 (1) of the Code of Criminal Procedure<\/strong><\/a> you can appeal to the court to decide on such objections. However, this does not automatically suspend enforcement - so there is no guarantee that such an application will prevent you from being detained. However, if there are reasonable doubts, the court can <strong data-start=\"2800\" data-end=\"2813\">preliminary<\/strong> order a stay of sentence or an interruption (section 458(3) of the Code of Criminal Procedure).<\/p><hr data-start=\"2889\" data-end=\"2892\" \/><h2 data-start=\"2894\" data-end=\"2947\">III. The classic way: postponement of sentence, \u00a7 456 StPO<\/h2><p data-start=\"2949\" data-end=\"3294\">The best known and practically most common lifeline is the <strong data-start=\"3011\" data-end=\"3028\">Suspended sentence<\/strong>. After <a href=\"https:\/\/dejure.org\/gesetze\/StPO\/456.html\">\u00a7 Section 456 Code of Criminal Procedure<\/a> At the request of the sentenced person, enforcement may be postponed by up to <strong data-start=\"3107\" data-end=\"3122\">four months<\/strong> be postponed if the immediate commencement of the <strong data-start=\"3178\" data-end=\"3238\">Significant disadvantages outside the purpose of the sentence<\/strong> would arise.<\/p><p data-start=\"3296\" data-end=\"3310\">Important here:<\/p><ul data-start=\"3312\" data-end=\"3877\"><li data-start=\"3312\" data-end=\"3370\"><p data-start=\"3314\" data-end=\"3370\">The application must <strong data-start=\"3330\" data-end=\"3337\">before<\/strong> before the start of detention.<\/p><\/li><li data-start=\"3371\" data-end=\"3546\"><p data-start=\"3373\" data-end=\"3546\">Enough is enough <strong data-start=\"3383\" data-end=\"3392\">not<\/strong> It is not sufficient to claim normal disadvantages (e.g. loss of employment) - these are regarded as normal \u201epenalties\u201c that the convicted person must accept.<\/p><\/li><li data-start=\"3547\" data-end=\"3662\"><p data-start=\"3549\" data-end=\"3662\">The disadvantages must <strong data-start=\"3570\" data-end=\"3589\">extraordinary<\/strong> and ideally can be eliminated during the deferral period.<\/p><\/li><li data-start=\"3663\" data-end=\"3754\"><p data-start=\"3665\" data-end=\"3754\">The duration is limited to a maximum of <strong data-start=\"3691\" data-end=\"3706\">four months<\/strong> limited.\u00a0<\/p><\/li><li data-start=\"3755\" data-end=\"3877\"><p data-start=\"3757\" data-end=\"3877\">The authorisation can be linked to conditions (e.g. provision of security).\u00a0<\/p><\/li><\/ul><p data-start=\"3879\" data-end=\"3952\">Examples where courts have granted a deferral in practice:<\/p><ul data-start=\"3954\" data-end=\"4224\"><li data-start=\"3954\" data-end=\"4018\"><p data-start=\"3956\" data-end=\"4018\">An independent contractor without a trained representative<\/p><\/li><li data-start=\"4019\" data-end=\"4079\"><p data-start=\"4021\" data-end=\"4079\">A convicted person about to complete an apprenticeship<\/p><\/li><li data-start=\"4080\" data-end=\"4136\"><p data-start=\"4082\" data-end=\"4136\">A student who would otherwise be at risk of losing a semester<\/p><\/li><li data-start=\"4137\" data-end=\"4224\"><p data-start=\"4139\" data-end=\"4224\">A family case, such as a seriously ill spouse or lack of childcare<\/p><\/li><\/ul><p data-start=\"4226\" data-end=\"4423\">A refusal can be reviewed by a court decision in accordance with Section 458 (2) of the Code of Criminal Procedure - however, this in turn does not automatically suspend enforcement.\u00a0<\/p><hr data-start=\"4425\" data-end=\"4428\" \/><h2 data-start=\"4430\" data-end=\"4489\">IV Suspension of sentence in the event of unfitness to stand trial, Section 455 StPO<\/h2><p data-start=\"4491\" data-end=\"4869\">Another option is the so-called <strong data-start=\"4529\" data-end=\"4546\">Suspended sentence<\/strong> (no pun intended): If the convicted person <strong data-start=\"4586\" data-end=\"4608\">unfit for execution<\/strong> If the offender is a person who cannot be detained in the prison for health reasons (e.g. serious illness, need of care, mental illness), the execution of the prison sentence may be suspended. <strong data-start=\"4785\" data-end=\"4801\">postponed<\/strong> or <strong data-start=\"4807\" data-end=\"4823\">interrupted<\/strong> become.\u00a0<\/p><p data-start=\"4871\" data-end=\"5053\">The following also applies here: If the application is rejected, an application pursuant to Section 458 (2) of the Code of Criminal Procedure is possible. However, even this does not automatically have an inhibiting effect.\u00a0<\/p><hr data-start=\"5055\" data-end=\"5058\" \/><h2 data-start=\"5060\" data-end=\"5134\">V. For organisational reasons &amp; reasons for execution (\u00a7 455a, \u00a7 456a StPO)<\/h2><ul data-start=\"5136\" data-end=\"5478\"><li data-start=\"5136\" data-end=\"5333\"><p data-start=\"5138\" data-end=\"5333\"><a href=\"https:\/\/dejure.org\/gesetze\/StPO\/455a.html\"><strong data-start=\"5138\" data-end=\"5153\">\u00a7 Section 455a StPO<\/strong><\/a>: A postponement or interruption may result from <strong data-start=\"5196\" data-end=\"5232\">Reasons for the enforcement organisation<\/strong> e.g. overcrowding, accidents or other hazards in prisons.<\/p><\/li><li data-start=\"5334\" data-end=\"5478\"><p data-start=\"5336\" data-end=\"5478\"><a href=\"https:\/\/dejure.org\/gesetze\/StPO\/456a.html\"><strong data-start=\"5336\" data-end=\"5351\">\u00a7 Section 456a StPO<\/strong><\/a>In the event of extradition, expulsion or transfer abroad, enforcement may be waived in whole or in part.<\/p><\/li><\/ul><p data-start=\"5480\" data-end=\"5550\">Such cases are rare and often linked to complex conditions.<\/p><hr data-start=\"5552\" data-end=\"5555\" \/><h2 data-start=\"5557\" data-end=\"5631\">VI. substitute custodial sentence: the \u201eticket\u201c to imprisonment often avoidable<\/h2><p data-start=\"5633\" data-end=\"5787\">If the summons to appear <strong data-start=\"5667\" data-end=\"5692\">Alternative custodial sentence<\/strong> (because a fine has not been paid), the chances are comparatively better:<\/p><ol data-start=\"5789\" data-end=\"6558\"><li data-start=\"5789\" data-end=\"6020\"><p data-start=\"5792\" data-end=\"6020\"><strong data-start=\"5792\" data-end=\"5833\">Payment of the original fine<\/strong><br data-start=\"5833\" data-end=\"5836\" \/>If the delayed or uncollectible part of the fine is paid in full, the alternative custodial sentence is cancelled and thus the prison sentence is not imposed.\u00a0<\/p><\/li><li data-start=\"6022\" data-end=\"6260\"><p data-start=\"6025\" data-end=\"6260\"><strong data-start=\"6025\" data-end=\"6082\">Repayment through community service or comparable work<\/strong><br data-start=\"6082\" data-end=\"6085\" \/>Under certain conditions, the uncollectible portion can be replaced by work (e.g. six hours of work per daily rate).\u00a0<\/p><\/li><li data-start=\"6262\" data-end=\"6558\"><p data-start=\"6265\" data-end=\"6558\"><strong data-start=\"6265\" data-end=\"6299\">Undue hardship (\u00a7 459 f StPO)<\/strong><br data-start=\"6299\" data-end=\"6302\" \/>In exceptional cases, the court may suspend the execution of the custodial sentence for reasons of hardship - for example, if imprisonment represents an unreasonable burden. However, such cases must be interpreted very narrowly.\u00a0<\/p><\/li><\/ol><p data-start=\"6560\" data-end=\"6716\">So if someone threatens you with a substitute custodial sentence in Bremen, it is usually worth taking the payment or labour application route first.<\/p><hr data-start=\"6718\" data-end=\"6721\" \/><h2 data-start=\"6723\" data-end=\"6755\">VII Path of clemency (clemency decree)<\/h2><p data-start=\"6757\" data-end=\"7058\">As a final option, a <strong data-start=\"6784\" data-end=\"6800\">Petition for clemency<\/strong> can be lodged. Such an application can lead to the enforcement being suspended completely or at least temporarily. In practice, however, success is rare and the mere application is usually not sufficient to prevent enforcement in the long term.<\/p><hr data-start=\"7060\" data-end=\"7063\" \/><h2 data-start=\"7065\" data-end=\"7128\">VIII. Conclusion and recommendations for action from a Bremen perspective<\/h2><p data-start=\"7130\" data-end=\"7167\">For the people of Bremen, this means<\/p><ul data-start=\"7169\" data-end=\"8035\"><li data-start=\"7169\" data-end=\"7332\"><p data-start=\"7171\" data-end=\"7332\">If you receive a summons to appear for sentencing, this usually means that the judgement is already legally binding - and this means that many classic options for attack are gone.<\/p><\/li><li data-start=\"7333\" data-end=\"7486\"><p data-start=\"7335\" data-end=\"7486\"><strong data-start=\"7335\" data-end=\"7360\">Alternative custodial sentence<\/strong>: In most cases, you can prevent detention from becoming necessary in the first place by making a payment or applying for labour.<\/p><\/li><li data-start=\"7487\" data-end=\"7815\"><p data-start=\"7489\" data-end=\"7815\"><strong data-start=\"7489\" data-end=\"7508\">Prison sentence<\/strong>: In exceptional cases, you can try to switch off <strong data-start=\"7556\" data-end=\"7586\">Postponement of sentence (\u00a7 456 StPO)<\/strong> to delay the start date by up to four months - but only if there are exceptional reasons. Ja \u2013 allerdings nur eingeschr\u00e4nkt und oft nur in Ausnahmef\u00e4llen. Nachfolgend eine strukturierte \u00dcbersicht \u00fcber die wichtigsten Optionen. I. Rechtskraft = kaum noch Eingriffsm\u00f6glichkeiten Bevor wir zu den konkreten Instrumenten kommen: Wichtig ist zu wissen, dass eine Strafantrittsladung in der Regel erst ergeht, wenn das zugrundeliegende Urteil oder Strafbefehlsurteil rechtskr\u00e4ftig ist. Das hei\u00dft: Die \u00fcbliche Rechtsmittelfrist (z.\u202fB. Berufung oder Revision) ist abgelaufen oder wurde ausgesch\u00f6pft. Konflikte zwischen Tenor und Gr\u00fcnden) Zweifel bei der Berechnung der Strafe (z.\u202fB. unklare Regelungen zur Anrechnung von Untersuchungshaft) Vollstreckungshindernisse wie Verj\u00e4hrung, Identit\u00e4tszweifel, Amnestie oder rechtsstaatswidrige Verfahrensverz\u00f6gerung Gem\u00e4\u00df \u00a7\u202f458 Abs.\u202f1 StPO kann man das Gericht anrufen, um \u00fcber solche Einwendungen zu entscheiden. Allerdings hemmt das nicht automatisch den Vollzug \u2013 es ist also keine Garantie, dass man schon durch einen solchen Antrag den Haftantritt verhindert. Das Gericht kann bei begr\u00fcndeten Zweifeln aber vorl\u00e4ufig einen Strafaufschub oder eine Unterbrechung anordnen (\u00a7\u202f458 Abs.\u202f3 StPO). III. Der klassische Weg: Strafaufschub, \u00a7\u202f456 StPO Der bekannteste und praktisch h\u00e4ufigste Rettungsanker ist der Strafaufschub. Nach \u00a7\u202f456 StPO kann auf Antrag des Verurteilten die Vollstreckung um bis zu vier Monate verschoben werden, sofern durch den sofortigen Antritt erhebliche, au\u00dferhalb des Strafzwecks liegende Nachteile entstehen w\u00fcrden. Wichtig dabei: Der Antrag muss vor dem Haftantritt gestellt werden. Es reicht nicht aus, normale Nachteile (z.\u202fB. Arbeitsplatzverlust) zu geltend zu machen \u2013 diese gelten als gew\u00f6hnliches \u201eStraf\u00fcbel\u201c, das der Verurteilte hinzunehmen hat. Sicherheitsleistung) verkn\u00fcpft werden.\u00a0 Beispiele, bei denen Gerichte in der Praxis einen Aufschub gew\u00e4hrt haben: Ein selbst\u00e4ndiger Unternehmer ohne eingearbeiteten Vertreter Ein Verurteilter kurz vor dem Abschluss einer Ausbildung Ein Student, f\u00fcr den sonst ein Semesterverlust droht Ein Familienfall etwa bei schwerkranker Ehepartnerin oder fehlender Kinderbetreuung Eine Ablehnung kann mit einer gerichtlichen Entscheidung nach \u00a7\u202f458 Abs.\u202f2 StPO \u00fcberpr\u00fcft werden \u2013 allerdings hemmt das wiederum nicht automatisch den Vollzug.\u00a0 IV. Strafausstand bei Vollzugsuntauglichkeit, \u00a7\u202f455 StPO Eine andere Option ist der sogenannte Strafausstand (kein Wortspiel): Wenn der Verurteilte vollzugsuntauglich ist, also aus gesundheitlichen Gr\u00fcnden nicht in der JVA inhaftiert werden kann (z.\u202fB. schwere Erkrankung, Pflegebedarf, Geisteskrankheit), kann der Vollzug der Freiheitsstrafe aufgeschoben oder unterbrochen werden.\u00a0 Auch hier gilt: Wird der Antrag abgelehnt, steht ein Antrag nach \u00a7\u202f458 Abs.\u202f2 StPO offen. Aber auch dieser greift nicht automatisch hemmend ein.\u00a0 V. Aus organisatorischen Gr\u00fcnden &amp; Vollzugsgr\u00fcnde (\u00a7\u202f455a, \u00a7\u202f456a StPO) \u00a7\u202f455a StPO: Ein Aufschub oder Unterbrechung kann aus Gr\u00fcnden der Vollzugsorganisation erfolgen, z.\u202fB. \u00dcberbelegung, Ungl\u00fccksf\u00e4lle oder sonstige Gef\u00e4hrdungen in Justizvollzugsanstalten. \u00a7\u202f456a StPO: Bei Auslieferung, Ausweisung oder \u00dcberstellung ins Ausland kann ganz oder teilweise von der Vollstreckung abgesehen werden. Solche F\u00e4lle sind selten und oft an komplexe Voraussetzungen gebunden. VI. Ersatzfreiheitsstrafe: Die \u201eEintrittskarte\u201c zur Haft oft vermeidbar Wenn die Strafantrittsladung eine Ersatzfreiheitsstrafe betrifft (weil eine Geldstrafe nicht gezahlt wurde), bestehen vergleichsweise bessere Chancen: Zahlung der urspr\u00fcnglichen GeldstrafeWird der verz\u00f6gerte oder uneinbringliche Teil der Geldstrafe vollst\u00e4ndig bezahlt, entf\u00e4llt die Ersatzfreiheitsstrafe und damit der Haftantritt.\u00a0 Tilgung durch gemeinn\u00fctzige oder vergleichbare ArbeitUnter bestimmten Voraussetzungen kann der uneinbringliche Teil durch Arbeit ersetzt werden (z.\u202fB. sechs Stunden Arbeit pro Tagessatz).\u00a0 Unbillige H\u00e4rte (\u00a7\u202f459\u202ff StPO)In Ausnahmef\u00e4llen kann das Gericht aus H\u00e4rteger\u00fcnden die Vollstreckung der Ersatzfreiheitsstrafe einstellen \u2013 etwa wenn die Haft eine unzumutbare Belastung darstellt.
