Sulingen \u2013 entstehen meist nicht nur die sichtbaren Sch\u00e4den (Reparaturkosten), sondern auch sogenannte Nutzungsausfallsch\u00e4den \u2013 also der Schaden, der dadurch entsteht, dass Sie Ihr Fahrzeug f\u00fcr eine gewisse Zeit nicht nutzen k\u00f6nnen. Das Recht sieht vor, dass Sie daf\u00fcr ebenfalls Ersatz verlangen k\u00f6nnen. Aber worauf kommt es genau an? Hier sind die wichtigsten Punkte. 1. Anspruch und Grundlagen Nach deutschem Schadensrecht (\u00a7\u202f249 BGB) haben Unfallgesch\u00e4digte Anspruch auf Ersatz desjenigen Zustands, in dem sie sich befunden h\u00e4tten, wenn der Unfall nicht stattgefunden h\u00e4tte \u2013 dazu geh\u00f6rt auch die Nutzungsm\u00f6glichkeit des Fahrzeugs. Der Anspruch auf Nutzungsausfall entsteht, wenn das Fahrzeug aufgrund des Unfalls nicht fahrbereit bzw. nicht verkehrssicher ist oder bei einem Totalschaden, solange kein Ersatzfahrzeug vorhanden ist. Sie haben als Gesch\u00e4digter oft die Wahl: Entweder nutzen Sie einen Mietwagen (der dem besch\u00e4digten Fahrzeug entspricht) oder Sie fordern eine Nutzungsausfallentsch\u00e4digung in Geld. Gerade in l\u00e4ndlicheren Regionen wie Sulingen, wo die Abh\u00e4ngigkeit vom eigenen Fahrzeug oft h\u00f6her ist als in Gro\u00dfst\u00e4dten, kann die fehlende Nutzungsm\u00f6glichkeit gro\u00dfe praktische Auswirkungen haben. 2. Berechnung der Nutzungsausfallentsch\u00e4digung Die Entsch\u00e4digung errechnet sich grunds\u00e4tzlich als Tagespauschale \u00d7 Anzahl der Ausfalltage. F\u00fcr die Tagespauschale wird h\u00e4ufig auf bew\u00e4hrte Tabellen zur\u00fcckgegriffen, etwa die Schwacke-Liste \/ Sanden\u2011Danner\u2011K\u00fcppersbusch. Darin wird das Fahrzeug nach Typ, Alter, Ausstattung etc. in eine Gruppe eingeordnet. F\u00fcr Fahrzeuge \u00fcber etwa 5 Jahre kann eine Herabstufung erfolgen. Bei Totalschaden wird oft die \u201eWiederbeschaffungsdauer\u201c herangezogen als Ausfallzeit. In unserer Kanzlei in Sulingen oder Bremen pr\u00fcfen wir regelm\u00e4\u00dfig solche Berechnungsgrundlagen im Rahmen Ihrer Schadenregulierung. 3. Dauer: Was geh\u00f6rt zu den Ausfalltagen? Der Zeitraum, f\u00fcr den Sie Nutzungsausfall verlangen k\u00f6nnen, umfasst typischerweise mehrere Teilzeitr\u00e4ume: Schadensermittlungszeitraum: Vom Unfall bis zum Gutachten bzw. bis feststeht, wie gro\u00df der Schaden ist. Verz\u00f6gerungen, die Sie nicht zu vertreten haben, sind mit einzurechnen. \u00dcberlegungszeitraum: Nachdem Sie das Gutachten erhalten haben \u2013 eine kurze Frist, um zu entscheiden, ob repariert oder Ersatzwagen beschafft wird. Oft 1\u20113 Tage. Reparaturdauer bzw. Wiederbeschaffungsdauer: Je nachdem, ob repariert wird oder bei Totalschaden Ersatz beschafft werden muss. Verz\u00f6gerungen, z.\u202fB. wegen Ersatzteilbeschaffung, fallen, soweit nicht vom Gesch\u00e4digten zu vertreten, zu Lasten des Sch\u00e4digers. Beispiel: Das OLG Celle hat in einem Fall 26 Tage Nutzungsausfall zugesprochen \u2013 nicht nur die reine Wiederbeschaffungsdauer, sondern auch Gutachtenzeit + \u00dcberlegungszeit wurden ber\u00fccksichtigt. Solche Entscheidungen sind auch f\u00fcr Gesch\u00e4digte in Bremen oder Sulingen von gro\u00dfer praktischer Bedeutung. 4. Rechtsprechung: Wichtiges Urteil Ein zentrales Urteil ist das Urteil des Bundesgerichtshofs vom 5. Februar 2013, Az. VI ZR 363\/11. Darin stellte der BGH klar: Der Anspruch auf Ersatz des Nutzungsausfalls umfasst nicht nur die notwendige Reparatur- oder Wiederbeschaffungsdauer, sondern zus\u00e4tzlich die Zeit f\u00fcr die Schadensfeststellung und eine angemessene \u00dcberlegungszeit. Dieses Urteil st\u00e4rkt die Rechte von Unfallgesch\u00e4digten erheblich \u2013 auch hier bei uns in der Region Bremen und Diepholz \u2013 und verhindert, dass Versicherer den Ersatzanspruch auf die reine Reparaturdauer verk\u00fcrzen. 5.
