In addition to coming to terms with the loss of a job, it is important to quickly find new career prospects. The law supports employees in this process with an important entitlement: time off to look for a new job in accordance with Section 629 of the German Civil Code (BGB). But what exactly does this mean?<\/p><p data-start=\"178\" data-end=\"537\">\u00a0<\/p><h2 data-start=\"539\" data-end=\"589\">Entitlement to time off - what's behind it<\/h2><p data-start=\"591\" data-end=\"996\">Following the termination of a permanent employment contract, employees have the right to look for a new job during the notice period - and not just after work. \u00a7 Section 629 of the German Civil Code (BGB) obliges employers to give employees a reasonable amount of time off at their request to attend job interviews or visit the employment agency.<\/p><p data-start=\"998\" data-end=\"1242\">It does not matter whether the termination was made by the employer or by the employee. The only decisive factor is that the employment relationship ends through termination - and not, for example, through retirement.<\/p><p data-start=\"998\" data-end=\"1242\">\u00a0<\/p><h2 data-start=\"1244\" data-end=\"1284\">Who can assert the claim<\/h2><p data-start=\"1286\" data-end=\"1672\">The prerequisite for entitlement is a permanent employment relationship. This means that fixed-term employment relationships can also be covered, provided they are not only short-term or temporary. It is also important that the leave of absence is expressly requested by the employee - the employer does not have to take action on its own.<\/p><p data-start=\"1674\" data-end=\"1993\">The request for time off should not be made just one day in advance. It is advisable to inform the employer at an early stage and state the planned duration. However, it is not necessary to give reasons or even disclose the potential new employer.<\/p><p data-start=\"1674\" data-end=\"1993\">\u00a0<\/p><h2 data-start=\"1995\" data-end=\"2026\">What counts as a \u201ejob search\u201c<\/h2><p data-start=\"2028\" data-end=\"2330\">Job searches not only include traditional job interviews, but also appointments at job fairs, headhunters, medical examinations as part of the application process and aptitude tests. Even interviews at the job centre or employment agency are covered by the regulation.<\/p><p data-start=\"2332\" data-end=\"2531\">However, employees must be able to demonstrate to the employer that the absence is for a specific purpose - private errands are not covered.<\/p><p data-start=\"2332\" data-end=\"2531\">\u00a0<\/p><h2 data-start=\"2533\" data-end=\"2573\">Duration and remuneration of the leave of absence<\/h2><p data-start=\"2575\" data-end=\"2845\">The law does not specify exactly how long the leave of absence may last. The benchmark is appropriateness - and this depends on the individual case. If employees have several meetings in other cities on different days, they may be granted multiple periods of leave.<\/p><p data-start=\"2847\" data-end=\"3248\">There is no clear regulation in the law on the question of payment. In practice, however, Section 616 of the German Civil Code (BGB) is often referred to, which provides for continued payment of wages for a \u201erelatively insignificant period\u201c. If the absence is therefore short and manageable, employees generally retain their entitlement to remuneration - unless this has been expressly excluded in the employment contract.<\/p><p data-start=\"2847\" data-end=\"3248\">\u00a0<\/p><h2 data-start=\"3250\" data-end=\"3293\">Holiday instead of time off? Not an option<\/h2><p data-start=\"3295\" data-end=\"3668\">Important to know: The entitlement to time off to look for a job is in addition to the holiday entitlement. This means that the employer cannot demand that employees use holiday days for this purpose. Subsequent offsetting against remaining leave is also not permitted. The two entitlements have different objectives and must be considered separately.<\/p><p data-start=\"3295\" data-end=\"3668\">\u00a0<\/p><h2 data-start=\"3670\" data-end=\"3723\">If the employer refuses the claim<\/h2><p data-start=\"3725\" data-end=\"4096\">If the employer does not comply with the request for time off, employees should not simply stay away from work. Instead, legal clarification is necessary. In urgent cases, a temporary injunction can also help. In addition, the employer may be liable for damages if a job interview is missed as a result of the refusal.<\/p><p data-start=\"3725\" data-end=\"4096\">If you need labour law support with time off job search.<\/p><p data-start=\"4411\" data-end=\"4573\"><strong data-start=\"4411\" data-end=\"4464\">Will I continue to receive my salary during this time?<br \/><\/strong>As a rule, yes - provided the leave of absence is only for a short period and \u00a7 616 BGB has not been excluded.<\/p><p data-start=\"4575\" data-end=\"4707\"><strong data-start=\"4575\" data-end=\"4625\">Does this also apply if I have cancelled the contract myself?<br \/><\/strong>Yes, the entitlement exists regardless of who gave notice of termination.<\/p><p data-start=\"4709\" data-end=\"4843\"><strong Doch was genau bedeutet das eigentlich? \u00a0 Anspruch auf Freistellung \u2013 was dahintersteckt Nach einer K\u00fcndigung eines auf Dauer angelegten Arbeitsverh\u00e4ltnisses haben Arbeitnehmende das Recht, sich w\u00e4hrend der K\u00fcndigungsfrist um eine neue Stelle zu bem\u00fchen \u2013 und zwar nicht nur nach Feierabend. \u00a7\u202f629 BGB verpflichtet die Arbeitgeberseite, auf Wunsch der Arbeitnehmenden eine angemessene Zeit freizugeben, um Vorstellungsgespr\u00e4che wahrzunehmen oder bei der Agentur f\u00fcr Arbeit vorstellig zu werden. Ob die K\u00fcndigung durch die Arbeitgeberseite oder durch die Arbeitnehmenden erfolgt ist, spielt dabei keine Rolle. Entscheidend ist lediglich, dass das Arbeitsverh\u00e4ltnis durch K\u00fcndigung endet \u2013 und nicht etwa durch Renteneintritt oder Ruhestand. \u00a0 Wer den Anspruch geltend machen kann Voraussetzung f\u00fcr den Anspruch ist ein auf Dauer angelegtes Arbeitsverh\u00e4ltnis. Das bedeutet: Auch befristete Arbeitsverh\u00e4ltnisse k\u00f6nnen erfasst sein, sofern sie nicht nur kurzfristig oder als Aushilfst\u00e4tigkeit ausgestaltet sind. Wichtig ist au\u00dferdem, dass die Freistellung ausdr\u00fccklich von den Arbeitnehmenden eingefordert wird \u2013 von allein muss die Arbeitgeberseite nicht aktiv werden. Dabei sollte der Antrag auf Freistellung nicht erst einen Tag vorher erfolgen. Es empfiehlt sich, die Arbeitgeberseite fr\u00fchzeitig zu informieren und die geplante Dauer zu benennen. Eine Begr\u00fcndung oder gar die Offenlegung der potenziellen neuen Arbeitgeberin oder des neuen Arbeitgebers ist hingegen nicht erforderlich. \u00a0 Was als \u201eStellensuche\u201c gilt Unter die Stellensuche fallen nicht nur klassische Bewerbungsgespr\u00e4che, sondern auch Termine bei Jobb\u00f6rsen, Headhunter*innen, \u00e4rztliche Untersuchungen im Rahmen des Bewerbungsprozesses oder auch Eignungstests. Selbst Gespr\u00e4che beim Jobcenter oder der Agentur f\u00fcr Arbeit sind von der Vorschrift gedeckt. Die Arbeitnehmenden m\u00fcssen allerdings in der Lage sein, der Arbeitgeberseite plausibel zu machen, dass es sich um eine zweckgebundene Abwesenheit handelt \u2013 private Erledigungen fallen nicht darunter. \u00a0 Dauer und Verg\u00fctung der Freistellung Wie lange die Freistellung dauern darf, ist gesetzlich nicht exakt festgelegt. Der Ma\u00dfstab ist die Angemessenheit \u2013 und die h\u00e4ngt vom Einzelfall ab. Haben Arbeitnehmende mehrere Gespr\u00e4che in anderen St\u00e4dten an verschiedenen Tagen, darf auch mehrfach freigestellt werden. Zur Frage der Bezahlung gibt es keine klare Regelung im Gesetz. In der Praxis wird jedoch h\u00e4ufig auf \u00a7\u202f616 BGB zur\u00fcckgegriffen, der eine Lohnfortzahlung bei \u201everh\u00e4ltnism\u00e4\u00dfig nicht erheblicher Zeit\u201c vorsieht. Ist die Abwesenheit also kurz und \u00fcberschaubar, behalten die Arbeitnehmenden in der Regel ihren Anspruch auf Verg\u00fctung \u2013 es sei denn, dieser wurde im Arbeitsvertrag ausdr\u00fccklich ausgeschlossen. \u00a0 Urlaub statt Freistellung? Keine Option Wichtig zu wissen: Der Anspruch auf Freistellung zur Stellensuche steht neben dem Urlaubsanspruch. Die Arbeitgeberseite kann also nicht verlangen, dass Arbeitnehmende hierf\u00fcr Urlaubstage verwenden. Auch eine nachtr\u00e4gliche Anrechnung auf Resturlaub ist unzul\u00e4ssig.
