However, it does not have to indicate the date on which the reference was actually issued (see e.g. Cologne Regional Labour Court, decision of 27 March 2020, <a title=\"LAG Cologne, 27.03.2020 - 7 Ta 200\/19: Date of a certificate\" href=\"https:\/\/dejure.org\/dienste\/vernetzung\/rechtsprechung?Text=7%20Ta%20200\/19\" target=\"_blank\" rel=\"noopener\">7 Ta 200\/19<\/a>).<\/p><p>It is customary to include the date of the legal termination of the employment relationship as the reference date. This has also been approved by the Federal Labour Court. On the one hand, this creates legal certainty. On the other hand, it prevents speculation as to whether a dispute has arisen between the parties to the employment contract regarding the issue and content of the reference. Such a dispute could arise if a longer period of time has elapsed between the legal end of the employment relationship and the time when the reference is actually issued. Therefore, in contrast to the interim reference, the termination date and not the date of issue should be included in the final reference.<\/p><p><strong>Errors are very common when preparing references. Das hat das Bundesarbeitsgericht auch h\u00f6chstrichterlich gebilligt. Dies schafft zum einen Rechtssicherheit. Zum anderen beugt es Spekulationen vor, ob zwischen den Arbeitsvertragsparteien ein Streit \u00fcber Erteilung und Inhalt des Zeugnisses ausgetragen worden ist. Ein solcher Streit k\u00f6nnte entstehen, wenn zwischen dem rechtlichen Ende des Arbeitsverh\u00e4ltnisses und dem Zeitpunkt der tats\u00e4chlichen Erstellung eines Zeugnisses ein l\u00e4ngerer Zeitraum verstrichen ist. Deshalb ist in das abschlie\u00dfende Arbeitszeugnis, anders als im Zwischenzeugnis, das Beendigungsdatum und nicht das Erstellungdatum aufzunehmen.
