Die gesetzliche Grundlage: \u00a7\u00a7 211 und 212 StGB Die Unterscheidung basiert auf zwei eigenen Straftatbest\u00e4nden des Strafgesetzbuches (StGB): \u00a7 211 StGB \u2013 Mord \u00a7 212 StGB \u2013 Totschlag Beide Delikte setzen voraus, dass das Leben eines anderen Menschen vors\u00e4tzlich beendet wurde. Der gro\u00dfe Unterschied: F\u00fcr Mord m\u00fcssen zus\u00e4tzliche sogenannte Mordmerkmale vorliegen. Diese Merkmale sind genau definiert und machen aus einem \u201eblo\u00dfen\u201c Totschlag juristisch einen Mord. \u00a0 2. Mordmerkmale: Wann eine T\u00f6tung als Mord gilt \u00a7 211 StGB nennt mehrere Mordmerkmale, die entweder die Beweggr\u00fcnde oder die Art und Weise der Tat betreffen. Liegt mindestens eines dieser Merkmale vor, handelt es sich strafrechtlich um Mord. Habgier liegt vor, wenn der:die T\u00e4ter:in t\u00f6tet, um sich selbst materiell zu bereichern \u2013 oder auch, um einen Verm\u00f6gensnachteil zu vermeiden. Mordlust liegt vor, wenn jemand t\u00f6tet, allein um des T\u00f6tens willen \u2013 also aus reiner Freude an der T\u00f6tungshandlung oder am Tod des Opfers. Heimt\u00fccke, Grausamkeit und gemeingef\u00e4hrliche Mittel Wer sein Opfer \u00fcberraschend in einem Moment der Wehrlosigkeit t\u00f6tet, handelt heimt\u00fcckisch. Grausamkeit liegt vor, wenn das Opfer besonders leidet. Gemeingef\u00e4hrliche Mittel sind etwa das Feuerlegen in einem bewohnten Haus oder das Lenken eines Fahrzeugs in eine Menschenmenge. Auch das T\u00f6ten zur Verdeckung einer anderen Straftat (z.\u202fB. eines Raubes oder einer Vergewaltigung) ist ein Mordmerkmal. \u00a0 3. Totschlag: Die \u201eT\u00f6tung ohne Mordmerkmal\u201c Fehlen diese besonderen Merkmale, aber liegt dennoch ein Vorsatz vor, handelt es sich um Totschlag gem\u00e4\u00df \u00a7 212 StGB. Auch hier handelt der:die T\u00e4ter:in absichtlich, jedoch ohne die erschwerenden Umst\u00e4nde, die den Mord kennzeichnen.Gerade bei emotional aufgeladenen Situationen \u2013 etwa einem eskalierenden Streit \u2013 kann schnell eine vors\u00e4tzliche T\u00f6tung entstehen, die jedoch kein Mord im strafrechtlichen Sinne ist. \u00a0 4. Unterschiede im Strafma\u00df Die Unterscheidung ist nicht nur juristisch, sondern auch f\u00fcr die Beschuldigten h\u00f6chst relevant, denn das Strafma\u00df unterscheidet sich deutlich: Mord (\u00a7 211 StGB): zwingend lebenslange Freiheitsstrafe Totschlag (\u00a7 212 StGB): Freiheitsstrafe nicht unter f\u00fcnf Jahren, in besonders schweren F\u00e4llen ebenfalls lebenslang Das bedeutet: Wird ein:e Beschuldigte:r wegen Mordes verurteilt, gibt es kein milderes Strafma\u00df. Bei Totschlag hingegen ist das Gericht freier in der Strafzumessung \u2013 abh\u00e4ngig vom konkreten Einzelfall. \u00a0 5. Verj\u00e4hrung: Mord verj\u00e4hrt nie Ein weiterer Unterschied: Mord verj\u00e4hrt nicht. Das bedeutet, auch Jahrzehnte nach der Tat kann ein:e Beschuldigte:r noch verfolgt werden. Beim Totschlag hingegen tritt nach 20 Jahren Verj\u00e4hrung ein. Diese Regelung zeigt, wie stark der Gesetzgeber den Mord als besonders verwerfliches Unrecht einstuft. \u00a0 6. Notwehr und Affekttaten: Strafrechtliche Einordnung mit Folgen Nicht jede T\u00f6tung ist automatisch Mord oder Totschlag.
