Quite a few people assume that small quantities for personal use have no legal consequences. But this mistake can be expensive: <strong>This is because even small quantities of illegal narcotics are punishable under the Narcotics Act (BtMG) - and since the Consumer Cannabis Act (KCanG) came into force, cannabis has been subject to very specific rules that are often misunderstood.<\/strong><br \/>In this article, we clarify when possession is a criminal offence, what the so-called \u201enot small quantity\u201c means and what the legal consequences are for possession, cultivation or even trafficking - especially in <strong>Bremen<\/strong>.<\/p><h4>1. when does possession constitute a criminal offence?<\/h4><p>In principle, the following applies: <strong>Der Besitz von Bet\u00e4ubungsmitteln ohne entsprechende Erlaubnis ist gem\u00e4\u00df <a href=\"https:\/\/dejure.org\/gesetze\/BtMG\/29.html\" title=\"&sect; 29 BtMG: Straftaten\">\u00a7 29 Abs. 1 Nr. 3 BtMG<\/a> punishable<\/strong> - regardless of whether they are \u201ehard\u201c or \u201esoft\u201c drugs. It does not matter whether the substances are to be consumed or not. <strong>Possession alone is enough<\/strong>. One exception is the KCanG, which permits the private consumption of cannabis.<\/p><p>The law enforcement authorities assume that a person is in possession of drugs if they <strong>be found with her<\/strong>, e.g. in clothing, in a vehicle or in the home - even if it is claimed that the substances belong to someone else. Even short-term storage (\u201eonly held for a short time\u201c) can be legally categorised as possession.<\/p><h4>2. new legal situation regarding cannabis: what is permitted, what remains a criminal offence?<\/h4><p>Since April 2024, cannabis <strong>partially decriminalised.<\/strong> According to the Consumer Cannabis Act <strong>(KCanG)<\/strong> persons of legal age:<\/p><ul><li><strong>up to 25 grams<\/strong> Carry cannabis with you,<\/li><li><strong>up to 50 grams in total<\/strong> store at home and<\/li><li><strong>up to three cannabis plants<\/strong> for their own use.<\/li><\/ul><p>However, these rules apply <strong>for private consumption only<\/strong> and are subject to strict conditions - such as a ban on consumption in the vicinity of schools, playgrounds and public events.<\/p><p>It becomes a criminal offence if:<\/p><ul><li>the authorised quantity <strong>exceeded<\/strong> becomes,<\/li><li><strong>more than three plants<\/strong> be cultivated,<\/li><li>or a <strong>Trade<\/strong> or a <strong>Disclosure to third parties<\/strong> takes place.<\/li><\/ul><p>One particularly important point: the boundary to the <strong>\u201enot a small amount\u201c<\/strong> lies with <strong>7.5 grams of pure THC.<\/strong> If this is exceeded - for example through possession of<strong> 60 grams of flowers with a THC content of 20 %<\/strong> (yields approx. 12 g THC) - threatens criminal prosecution according to <strong>\u00a7 Section 34 (1) KCanG<\/strong>, with sometimes drastic consequences.<\/p><h4><strong>3. not small quantities - when does it get really serious?<\/strong><\/h4><p>In narcotics law, the distinction between <strong>\u201elower\u201c<\/strong>, <strong>\u201emore \u201cnormal\"<\/strong> and <strong>\u201enot small quantity\u201c<\/strong> central. Significantly harsher penalties apply for offences involving more than a small quantity - and proceedings are usually <strong>no longer set.<\/strong><\/p><p>These threshold values differ depending on the substance and always refer to the <strong>pure active ingredient content.<\/strong> Here are some guidelines:<\/p><ul><li>\u201eNot small quantity\u201c from (pure active substance in g)<br \/><strong>Cannabis (THC)<\/strong>, if not self-consumption<br \/>7,5 g<\/li><li><strong>Amphetamine<\/strong><br \/>10,0 g<\/li><li><strong>MDMA<\/strong><br \/>30,0 g<\/li><li><strong>Heroin<\/strong><br \/>1,5 g<\/li><li><strong>Cocaine<\/strong><br \/>5,0 g<\/li><li><strong>Methamphetamine<\/strong><br \/>5,0 g<\/li><li><strong>Morphine<\/strong><br \/>4,5 g<\/li><\/ul><p><strong>Attention<\/strong>These values are not to be understood as \u201elicence limits\u201c! Possession is <strong>already from small quantities<\/strong> <strong>punishable<\/strong>, even if courts may discontinue proceedings in such cases <strong>can<\/strong> - <strong>but do not have to.<\/strong><\/p><h4>4. illegal drug trafficking - high penalties loom<\/h4><p>Who with drugs <strong>trades<\/strong>, is always liable to prosecution - even if only small quantities are involved. Even the <strong>Trade in a small quantity<\/strong> <strong>Cannabis for personal use<\/strong> can be punished with up to 3 years imprisonment or a fine in accordance with Section 34 (1) No. 4 KCanG.<\/p><p>In the case of larger quantities of other narcotics - especially if the <strong>not a small amount<\/strong> - there is a risk of more serious consequences:<\/p><ul><li><a href=\"https:\/\/dejure.org\/gesetze\/BtMG\/29a.html\" title=\"&sect; 29a BtMG: Straftaten\">\u00a7 29a Abs. 1 Nr. 2 BtMG<\/a>: Handel mit nicht geringer Menge \u2013 Mindeststrafe: <strong>1 year<\/strong>, maximum penalty:<strong> 15 years<\/strong><\/li><li>In less serious cases: <strong>3 months<\/strong> until<strong> 5 years<\/strong> Prison sentence<\/li><li><a href=\"https:\/\/dejure.org\/gesetze\/BtMG\/30a.html\" title=\"&sect; 30a BtMG: Straftaten\">\u00a7 30a Abs. 1 BtMG<\/a>: Bandenm\u00e4\u00dfiger Handel oder Handel mit Waffen \u2013 Freiheitsstrafe <strong>not under 5 years<\/strong><\/li><li>Delivery to minors: offender over 21 years - <strong>at least 1 year<\/strong> Prison sentence<\/li><\/ul><p>The level of punishment always depends on the circumstances of the individual case - for example, whether an organised structure is involved, whether weapons were involved or whether minors are affected. Besitz von Drogen wird von vielen \u2013 vor allem, wenn es um nicht geringe Mengen geht \u2013 untersch\u00e4tzt. Nicht wenige gehen davon aus, dass kleine Mengen f\u00fcr den Eigenbedarf rechtlich folgenlos bleiben. Doch dieser Irrtum kann teuer werden: Denn auch geringe Mengen illegaler Bet\u00e4ubungsmittel sind nach dem Bet\u00e4ubungsmittelgesetz (BtMG) strafbar \u2013 und seit Inkrafttreten des Konsumcannabisgesetzes (KCanG) gelten f\u00fcr Cannabis ganz eigene Regeln, die h\u00e4ufig missverstanden werden.In diesem Beitrag kl\u00e4ren wir, ab wann der Besitz strafbar ist, was es mit der sogenannten \u201enicht geringen Menge\u201c auf sich hat und welche rechtlichen Konsequenzen bei Besitz, Anbau oder gar Handel drohen \u2013 insbesondere in Bremen. 1. Wann liegt ein strafbarer Besitz vor? Grunds\u00e4tzlich gilt: Der Besitz von Bet\u00e4ubungsmitteln ohne entsprechende Erlaubnis ist gem\u00e4\u00df \u00a7 29 Abs. 1 Nr. 3 BtMG strafbar \u2013 und zwar unabh\u00e4ngig davon, ob es sich um \u201eharte\u201c oder \u201eweiche\u201c Drogen handelt. Dabei kommt es nicht darauf an, ob die Substanzen konsumiert werden sollen oder nicht \u2013 allein der Besitz gen\u00fcgt. Eine Ausnahme bildet das KCanG, das den privaten Konsum von Cannabis erlaubt. Die Strafverfolgungsbeh\u00f6rden gehen davon aus, dass eine Person Drogen besitzt, wenn diese bei ihr gefunden werden, z.\u202fB. in der Kleidung, im Fahrzeug oder in der Wohnung \u2013 selbst dann, wenn behauptet wird, dass die Substanzen jemand anderem geh\u00f6ren. Auch ein kurzfristiges Aufbewahren (\u201enur kurz gehalten\u201c) kann rechtlich als Besitz gewertet werden. 2. Neue Rechtslage bei Cannabis: Was ist erlaubt, was bleibt strafbar? Seit April 2024 ist Cannabis teilweise entkriminalisiert. Nach dem Konsumcannabisgesetz (KCanG) d\u00fcrfen vollj\u00e4hrige Personen: bis zu 25 Gramm Cannabis mit sich f\u00fchren, insgesamt bis zu 50 Gramm zu Hause aufbewahren und bis zu drei Cannabispflanzen zum Eigenbedarf anbauen. Diese Regeln gelten jedoch nur f\u00fcr den privaten Konsum und unterliegen strengen Auflagen \u2013 etwa einem Konsumverbot in der N\u00e4he von Schulen, Spielpl\u00e4tzen und \u00f6ffentlichen Veranstaltungen. Strafbar wird es dann, wenn: die zul\u00e4ssige Menge \u00fcberschritten wird, mehr als drei Pflanzen angebaut werden, oder ein Handel oder eine Weitergabe an Dritte erfolgt. Ein besonders wichtiger Punkt: Die Grenze zur \u201enicht geringen Menge\u201c liegt bei 7,5 Gramm reinem THC. Wird diese \u00fcberschritten \u2013 etwa durch Besitz von 60 Gramm Bl\u00fcten mit einem THC-Gehalt von 20\u202f% (ergibt ca. 12 g THC) \u2013 droht eine Strafverfolgung nach \u00a7 34 Abs. 1 KCanG, mit teils drastischen Konsequenzen. 3. Nicht geringe Mengen \u2013 ab wann wird\u2019s richtig ernst? Im Bet\u00e4ubungsmittelrecht ist die Unterscheidung zwischen \u201egeringer\u201c, \u201enormaler\u201c und \u201enicht geringer Menge\u201c zentral. Ab einer nicht geringen Menge gelten deutlich sch\u00e4rfere Strafrahmen \u2013 und Verfahren werden in der Regel nicht mehr eingestellt. Diese Schwellenwerte unterscheiden sich je nach Substanz und beziehen sich immer auf den reinen Wirkstoffgehalt. Hier einige Richtwerte: \u201eNicht geringe Menge\u201c ab (reinem Wirkstoff in g)Cannabis (THC), wenn nicht Eigenkonsum7,5 g Amphetamin10,0 g MDMA30,0 g Heroin1,5 g Kokain5,0 g Methamphetamin5,0 g Morphin4,5 g Achtung: Diese Werte sind nicht als \u201eErlaubnisgrenzen\u201c zu verstehen! Der Besitz ist bereits ab kleineren Mengen strafbar, auch wenn Gerichte in solchen F\u00e4llen unter Umst\u00e4nden das Verfahren einstellen k\u00f6nnen \u2013 aber nicht m\u00fcssen. 4. Illegaler Handel mit Drogen \u2013 hohe Strafen drohen Wer mit Drogen handelt, macht sich in jedem Fall strafbar \u2013 auch dann, wenn es sich nur um geringe Mengen handelt. Schon der Handel mit einer geringen Menge Cannabis zum Eigenkonsum kann nach \u00a7 34 Abs. 1 Nr. 4 KCanG mit bis zu 3 Jahren Freiheitsstrafe oder Geldstrafe geahndet werden. Bei gr\u00f6\u00dferen Mengen anderer Bet\u00e4ubungsmittel \u2013 insbesondere bei \u00dcberschreiten der nicht geringen Menge \u2013 drohen empfindlichere Konsequenzen: \u00a7 29a Abs. 1 Nr. 2 BtMG: Handel mit nicht geringer Menge \u2013 Mindeststrafe: 1 Jahr, H\u00f6chststrafe: 15 Jahre In minder schweren F\u00e4llen: 3 Monate bis 5 Jahre Freiheitsstrafe \u00a7 30a Abs. 1 BtMG: Bandenm\u00e4\u00dfiger Handel oder Handel mit Waffen \u2013 Freiheitsstrafe nicht unter 5 Jahren Abgabe an Minderj\u00e4hrige: T\u00e4ter:in \u00fcber 21 Jahre &#8211; mindestens 1 Jahr Freiheitsstrafe Die Strafh\u00f6he richtet sich stets nach den Umst\u00e4nden des Einzelfalls \u2013 etwa ob es sich um eine organisierte Struktur handelt, ob Waffen im Spiel waren oder ob Minderj\u00e4hrige betroffen sind. Gerade bei schweren Vorw\u00fcrfen ist eine schnelle und kompetente Verteidigung durch spezialisierte Anw\u00e4lt:innen entscheidend. 5.
