Was macht eine Strafverteidigung eigentlich aus? In Deutschland hat jede:r Beschuldigte das Recht, sich durch eine:n Strafverteidiger:in vertreten zu lassen (\u00a7 137 StPO). Dieser rechtliche Beistand begleitet den:die Mandant:in durch alle Phasen des Strafverfahrens \u2013 vom ersten Kontakt mit der Polizei bis zum Urteil. In bestimmten Konstellationen ist eine sogenannte notwendige Verteidigung gesetzlich vorgeschrieben (\u00a7 140 StPO). Das ist z.\u202fB. der Fall, wenn eine Freiheitsstrafe von einem Jahr oder mehr im Raum steht, das Verfahren vor dem Landgericht oder Oberlandesgericht stattfindet, eine Untersuchungshaft angeordnet wurde oder die Gefahr eines Berufsverbots besteht. In solchen F\u00e4llen darf sich der:die Beschuldigte nicht selbst verteidigen \u2013 ein:e Strafverteidiger:in ist zwingend erforderlich. \u00a0 2. Pflichtverteidigung oder Wahlverteidigung \u2013 wo liegt der Unterschied? Wer sich selbst eine:n Anwalt:Anw\u00e4ltin aussucht, spricht von einem: Wahlverteidiger:in. Dieses Recht steht allen Beschuldigten jederzeit zu \u2013 unabh\u00e4ngig vom Stand des Verfahrens. In F\u00e4llen der notwendigen Verteidigung kann ebenfalls eine freie Auswahl getroffen werden. Erfolgt keine Benennung, bestellt das Gericht von Amts wegen einen: Pflichtverteidiger:in. Gut zu wissen: Pflichtverteidiger:innen sind ebenfalls zugelassene Rechtsanw\u00e4lt:innen. Trotzdem gilt: Wer Einfluss auf die Verteidigungsstrategie nehmen m\u00f6chte, sollte m\u00f6glichst fr\u00fch eine:n eigene:n Verteidiger:in beauftragen. \u00a0 3. Was macht ein:e Strafverteidiger:in konkret? Die Rolle eines:einer Strafverteidiger:in geht weit \u00fcber den reinen Gerichtstermin hinaus. Ziel ist es, das bestm\u00f6gliche Ergebnis f\u00fcr den:die Mandant:in zu erreichen \u2013 sei es durch Verfahrenseinstellung, Freispruch oder Strafmilderung. Zu den wichtigsten Aufgaben geh\u00f6ren: Akteneinsicht beantragen: Nur wer die Ermittlungsakte kennt, kann eine tragf\u00e4hige Verteidigungsstrategie entwickeln. Rechte wahren: Der:die Verteidiger:in achtet darauf, dass keine Verfahrensfehler passieren, und r\u00fcgt gegebenenfalls Verst\u00f6\u00dfe. Strategieentwicklung: Je nach Beweislage wird entschieden, ob eine Aussage sinnvoll ist \u2013 oder ob Schweigen der kl\u00fcgere Weg ist. Verhandlungsf\u00fchrung: Im Prozess wird aktiv Einfluss auf das Verfahren genommen, etwa durch Antr\u00e4ge, Beweisantr\u00e4ge oder gezielte Befragung von Zeug:innen. Kurzum: Strafverteidigung ist kein reines \u201eBegleiten\u201c, sondern ein aktives Mitgestalten des Verfahrens \u2013 mit klarer Strategie und dem Ziel, Schaden abzuwenden. \u00a0 4. Verhalten bei polizeilicher Vorladung: Ihre Rechte auf einen Blick Wenn Sie Post von der Polizei oder Staatsanwaltschaft bekommen, gilt: Nicht \u00fcberst\u00fcrzt reagieren! Hier ein paar wichtige Punkte, die Sie beachten sollten: Sie sind nicht verpflichtet, einer polizeilichen Vorladung Folge zu leisten. Machen Sie keine Aussage, bevor Sie mit einem:er Strafverteidiger:in gesprochen haben. Aussagen, die unter Zwang, T\u00e4uschung oder durch psychischen Druck zustande kamen, sind nicht verwertbar. Sich selbst zu verteidigen mag mutig wirken \u2013 ist aber oft ein Fehler mit Folgen. Ohne fundierte Kenntnisse des Strafrechts und der Verfahrensregeln ist es schwer, Fehler der Staatsanwaltschaft oder des Gerichts zu erkennen.
